ARTICLE 2 – SUBJECT The subject of this Agreement is to determine the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of the product(s) ordered by the BUYER electronically via the https://www.google.com/search?q=atelierbyb.com website.

ARTICLE 3 – DETERMINATION OF THE PRODUCT, PAYMENT, AND DELIVERY

  • 3.1. Products: The basic characteristics of the goods or services are available at https://www.google.com/search?q=atelierbyb.com. The announced prices are valid until updated. All taxes are included in the sales price.

  • 3.2. Delivery Method and Plan: Following the procurement of the ordered products, the shipment process will begin within 3-5 business days depending on the category. Unless otherwise stated on the website, shipping is free and the cost shall be covered by the SELLER.

  • 3.3. Default Interest: Since payments are made in advance or by credit card, no default interest is applied by the SELLER.

ARTICLE 4 – GENERAL PROVISIONS

  1. The BUYER declares that they have read the preliminary information on the website regarding the basic characteristics, price, payment, and delivery of the product and provided the necessary confirmation in the electronic environment.

  2. The product shall be delivered to the BUYER or the person/organization at the indicated address within the period explained on the website, provided that it does not exceed the legal 30-day limit.

  3. The SELLER cannot be held responsible if the person/organization to be delivered to does not accept the delivery.

  4. The BUYER shall bear any damages and costs resulting from the late receipt of the product or the product being returned to the SELLER due to the BUYER not being present at the address.

  5. If the relevant bank or financial institution does not pay the product price to the SELLER due to the unfair or unlawful use of the BUYER's credit card by unauthorized persons, the BUYER must return the product to the SELLER within 3 days, provided it has been delivered to them. Shipping costs for returns in this case belong to the BUYER.

ARTICLE 5 – REFUND PROCEDURE In cases where the BUYER exercises the right of withdrawal or the product cannot be supplied for various reasons, the total amount collected will be returned to the relevant bank within 14 days after the cancellation. The reflection of this amount on the BUYER's account is entirely related to the bank's internal processes.

ARTICLE 6 – RIGHT OF WITHDRAWAL 6.1. The Consumer has the right to withdraw from the contract by rejecting the goods within 14 days from the date of receipt without any legal or criminal liability and without giving any justification. 6.2. EXCEPTION: Some products sold on our website are made-to-order (custom tailored), and returns are not accepted for these specific items. This notice is clearly stated on the detail pages of the relevant products. 6.3. If the right of withdrawal is exercised using the SELLER's contracted cargo company, the return shipping costs shall be borne by the SELLER.

ARTICLE 7 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED Unless otherwise agreed by the parties, the consumer cannot exercise the right of withdrawal in the following contracts:

  • Goods prepared in line with the consumer's requests or personal needs (custom tailoring, etc.).

  • Goods that can perish quickly or reach their expiration date.

  • Goods whose protective elements such as packaging, tape, and seals have been opened after delivery and whose return is not suitable for health and hygiene (underwear, earrings, etc.).

  • Services performed instantly in the electronic environment or intangible goods delivered instantly to the consumer.

ARTICLE 8 – AUTHORIZED COURT In disputes arising from the implementation of this Agreement, Turkish Law is applicable, and the Adana (Central) Courts and Execution Offices are authorized.

This Agreement has been read, accepted, and confirmed by the parties in the electronic environment.
